ETHICS: ETHICS VERSUS CONTRACT

You are an engineer engaged by a developer to prepare design documentation for a major residential development in accordance with a specific architectural design.

During the documentation phase, the developer requested a number of significant changes to the architectural concepts. The architect was not advised that these changes resulted from input from another architect.

The final plans have been approved by Council, and construction is about to commence. However, the developer advises you that the original architect is to be terminated and you are to modify your original drawings to the specifications of the second architect.

The developer has demanded that you do not reveal to the first architect that his contract is about to be terminated. The first architect has some remaining deliverables on the project and you are to act as if nothing is wrong, until that modified concepts are approved by Council.

You feel compelled to advise the first architect of the situation, but are conscious of your contractual relationship with the developer and to the specific requirement of confidentiality.

It is proposed that you tell the first architect what you know.
